The Ministry of Industry and Trade conducts an investigation to apply anti-dumping measures to cold-rolled (cold-pressed) carbon steel products in coils or plates.
At the beginning of May 2019, three enterprises representing Vietnam's cold-rolled steel industry include: Phu My Sheet Steel One Member Limited Company - VNSTEEL, Posco Co., Ltd - Vietnam and China Joint Stock Company. Steel Sumikin Vietnam has simultaneously submitted a petition to the Ministry of Industry and Trade with the allegation that: Flat-rolled non-alloy or alloy steel products in coils or sheets imported from China are dumped in the Vietnamese market.
Specifically, the above-mentioned steel enterprises said that flat-rolled non-alloy or alloy steel products in coils or sheets, with a width of less than 1,600mm and thickness from 0.108mm to 2.55mm, were annealed or not annealed, coated or coated with inorganic matter or not coated or coated and not further worked than cold-rolled imports from China that have been dumped into the Vietnamese market at a margin of dumping by 21.3%.
"This dumping behavior is the main cause of significant damage to Vietnam's cold-rolled steel industry," the three businesses stated the consequences.
Before the above recommendation, on September 3, on the basis of the request dossier of the representative of the domestic manufacturing industry and in accordance with relevant legal regulations, the Ministry of Industry and Trade issued Decision No. 2703/QD-BCT on conducting an investigation to apply anti-dumping measures to a number of cold-rolled (cold-pressed) carbon steel products in coils or sheets (commonly known as cold-rolled steel) originating from China imported from China. export to Vietnam.
According to the law, after initiating an investigation, the Ministry of Industry and Trade will send an investigation questionnaire to relevant parties to collect information in order to analyze and evaluate the alleged contents, including: prices of Chinese exporters; injury to Vietnam's cold-rolled steel industry and the causal relationship between dumping and injury to the cold-rolled steel industry.
In necessary cases, based on preliminary investigation results, the Ministry of Industry and Trade may apply temporary anti-dumping measures to prevent dumping from continuing to cause significant damage to the industry. domestically produced.
“The Ministry of Industry and Trade will verify and verify the information provided by relevant parties before completing the official investigation conclusion on the case. At the same time, the Ministry of Industry and Trade will also hold public consultations so that relevant parties can directly exchange, provide information and express their views on the case before reaching a final conclusion on the case. specified.
The Ministry of Industry and Trade also recommends all organizations and individuals that are importing, exporting, distributing, trading and using investigated goods to register as related parties and provide necessary information to the Ministry of Industry and Trade. to ensure their rights and interests as prescribed by law.
The Ministry of Industry and Trade may apply retroactive anti-dumping duties on the goods subject to the tax within 90 days before the imposition of the provisional anti-dumping duty. Therefore, the Ministry of Industry and Trade recommends that organizations and individuals in the process of signing contracts for import, distribution, business and use of investigated goods should pay attention to the possibility of applying anti-dumping tax. provisional and retroactive anti-dumping duties.
